- VIRTUAL-TRY-ON FEATURE
This Website may provide you with a make-up or hair-color try-on feature. You can choose the live service (using your device webcam) or an existing picture (uploaded from your device).
The result of the experience (picture with make-up or hair-color) can be downloaded on your device and you may have the option to share it on social platforms. You are free not to use this service.
Pictures are not stored by Us, unless you use the sharing on social platforms, in such case, the picture will be stored during 49 hours. The picture is deleted automatically after such period.
If you share the result of the experience outside of the virtual-try-on feature (through native features available in your device) We are not involved in such sharing (no personal data processing by Us).
- SKIN ANALYSIS FEATURE
This Website may allow you to use a skin analysis feature. This is an online service capable of analyzing skin aging with one picture based on artificial intelligence. Your picture is analyzed and then, based on your age and skin type, you will be provided with your skin results and a personalized skincare routine. You have the possibility to receive the report and the product recommendation via e-mail and to subscribe to the newsletter. You are free not to use this service.
The picture collected through this service is only used to perform the skin analysis and is deleted automatically post analysis.
4. INTELLECTUAL PROPERTY
a. Intellectual property rights
Developing this Website involved significant investments. The Website and each of the elements it comprises (i.e., brands, images, texts, videos, etc.) are protected by intellectual property rights. No use, reproduction or representation of the Website (in whole or in part), on any media whatsoever, for any other purposes, including, but not limited to, commercial purposes, shall be authorized.
We may make available to you via this Website contents that you are authorized to download (hereinafter the "Downloadable Content"). If any provision of these Terms is found to be invalid by any court having jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.
We do not endorse or control the User Content transmitted or posted on the Site and therefore, we do not guarantee the accuracy, integrity or quality of User Content. You understand that by using the Site, you may be exposed to User Content that is offensive, indecent or objectionable to you. 1. These are the terms and conditions for the GARNIER PURE ACTIVE AHA+ BHA CHARCOAL SERUM “MONEY BACK GUARANTEE" Challenge ("Challenge").
2. The promoter of the Challenge is L’Oréal South Africa Proprietary Limited ("Promoter").
3. The Challenge is open to only South Africans holding a valid South African identity document and who are 18 years and older and excludes the Promoter, the Promoter’s advertising and promotional agencies, any directors, members, partners, agents, employees or consultants of the Promoter, any supplier of goods or services in connection with the Challenge and the spouse, life partner, business partner or associate, parent, child, or sibling, of any of the persons specified aforesaid ("Qualifying Participants").
4. DURATION
The Challenge shall commence at 08:00 on 1 June 2024 ("Commencement Date") until 23:59 on 31 July 2024 ("End Date") (8 Weeks for Products bought by 30 June 2024) within which the Qualifying Participants are to purchase the Qualifying Products as set out in clause 5 during the Duration.

7. If a Qualifying Participant does not feel satisfied with the results despite using the Qualifying Product and any Additional Products daily for 8 weeks following the product usage instructions, the Qualifying Participant may request a full refund for their purchase of the Qualifying Product only. In order to request a refund, the Qualifying Participant must send an email tolorealconsumerrsa@loreal.com within 8 weeks from the End Date of the Challenge, and must include the following in the email:
7.1 reasons for being unsatisfied with the use of the Qualifying Product
7.2 a copy of the “before” full face photograph (refer clause 6.3 above);
7.3 a copy of an “after” photograph of his / her full face without makeup, date stamped within two (2) days of completing the Challenge;
7.4 a copy of the invoice/receipt (refer clause 6.5 above); and
7.5 clearly legible photographs of the empty Qualifying Product containers (refer clause 6.6 above).
8. The refund will be subject to verifying that:
8.1 The Qualifying Product has been purchased during the Duration of the Challenge (refer clause 4 above),
8.2 the Qualifying Product has been used correctly, in accordance with the instructions and indications of use as provided on the Qualifying Product and
8.3 the request for a refund was made after using the Qualifying Product twice daily for 8 (eight) consecutive weeks after purchase.
Refund requests will not be accepted where no minimum 8 weeks of use have elapsed after purchase.
9. The Qualifying Participant will be notified of the Promotor’s decision to refund the Qualifying Participant for the purchase of the Qualifying Product. In order for the refund to be effected by the Promotor, the Qualifying Participant is required to provide the following:
9.1 The Qualifying Participant’s ID Number,
9.2 proof of residence
9.3 bank details.
Once the Qualifying Participant has submitted the information and or documents requested in clauses 9.1, 9.2 and 9.3 above and duly verified by the Promoter, the Promoter will refund the Qualifying Participant for the Qualifying Product into the Qualifying Participant’s bank account within 21 days.
10. Should a Qualifying Participant fail to comply with these Terms and Conditions, the Qualifying Participant will not be eligible for a refund.
11. In the event of (i) fraud by a Qualifying Participant, (ii) attempted fraud by a Qualifying Participant, (iii) bad faith by a Qualifying Participant, or (iv) a Qualifying Participant failing to comply with the Terms and Conditions, such Qualifying Participant may be disqualified. If the refund has already been effected by the Promoter, the Promoter may revoke such refund and take the necessary actions for the purposes of preventing and / or demanding the return of the refund.
12. A Qualifying Participant may participate in the Challenge only once. The refund under this Challenge is only valid for 1 (one) product purchase of 1 (one) Qualifying Product per household. Should a Qualifying Participant purchase more that 1 (one) Qualifying Product per household, the Qualifying Participant shall only be entitled to participate in the Challenge and submit a claim in respect of 1 (one) Qualifying Product.

7. If a Qualifying Participant does not feel satisfied with the results despite using the Qualifying Product and any Additional Products daily for 8 weeks following the product usage instructions, the Qualifying Participant may request a full refund for their purchase of the Qualifying Product only. 7.1 reasons for being unsatisfied with the use of the Qualifying Product

7.4 a copy of the invoice/receipt (refer clause 6.5 above); and
7.5 clearly legible photographs of the empty Qualifying Product containers (refer clause 6.6 above).
8. The refund will be subject to verifying that:

10. Should a Qualifying Participant fail to comply with these Terms and Conditions, the Qualifying Participant will not be eligible for a refund.
11. In the event of (i) fraud by a Qualifying Participant, (ii) attempted fraud by a Qualifying Participant, (iii) bad faith by a Qualifying Participant, or (iv) a Qualifying Participant failing to comply with the Terms and Conditions, such Qualifying Participant may be disqualified. If the refund has already been effected by the Promoter, the Promoter may revoke such refund and take the necessary actions for the purposes of preventing and / or demanding the return of the refund.
12. A Qualifying Participant may participate in the Challenge only once. The refund under this Challenge is only valid for 1 (one) product purchase of 1 (one) Qualifying Product per household. Should a Qualifying Participant purchase more that 1 (one) Qualifying Product per household, the Qualifying Participant shall only be entitled to participate in the Challenge and submit a claim in respect of 1 (one) Qualifying Product.
